The company referred to as Sonata Software dba Peter A Donovan NOT to be confused with Sonata Software LTD based in India are bound legally by US Trademark no. 2,399,381 to either contest or agree where SonataSoftware.Com (Sonata Software LTD) has been email notified Sonata Software dba Peter A Donovan must take measures to "cease and desist from any and all uses of the word 'Sonata' for software services...".

It seems that even though Sonata Software, dba Peter A Donovan has a valid software license from Data Access Corp of Miami FL, dated July 31 1991, to develop custom software, that the Trademark, dated October 31st 2000 outweighs (legally) the right of Sonata Software dba Peter A Donovan to continue doing business utilizing the name 'Sonata'.

Therefore, Sonata Software dba Peter A Donovan has decided to split the company and do business as Applause Software (pending approval by a number of parties) and totally redefine the business of Sonata Software to produce and market multimedia videos ONLY.

Peter Donovan has a history of producing multimedia instructional videos as both free and paid copies of technical programming techniques for Visual DataFlex programmers and has also produced corporate training video. This was a small part of Sonata Software dba Peter A Donovan's revenue and was done mostly for altruistic measures to help other programmers learn Visual DataFlex programming techniques.

Therefore, the split can be seen TODAY November 22nd, 2006 for the first time, in cooperation with the litigation posed, considering the timeframe that one person can manage to negotiate, respond, and purchase/ redesign two seperate web pages and split a company.

Based on legal advice, the author has some valuable advice for other firms!

Even though your website name is paid for and your company is established for 25 years, you can still lose the right to do business under your name if someone trademarks it first!

Personally, I recommend that anyone reading this article who owns a business, seek the advice of a trademark attorney (or www.TradeMarkMyName.Com) in order to confirm what this article is about.

Finally, it is hoped that this settles the dispute as the author (Peter A Donovan) gives way to a 110M corporation trademark.
